1. Choose Wisely. Chocolate, candy, and other sweets contain empty calories that can translate into high amounts of fat, sugar, salt and not many vitamins or minerals. Instead of splurging on everything, opt for one of your favorites. You don’t have to eat everything you love in one day.
    
2. Reasonable Portions. Be mindful of the serving size of your treat. Many junk foods come in mini, prepackaged portions. Aim for no more than 200 calories.

Canyon Ranch (“Sponsor”) is pleased to introduce the [Canyon Ranch Online Healthy Weight Coaching Program] (the “Promotion”) made available at www.sparkpeople.com/blog (the “Site”). The Promotion begins at 3:00:01 pm Pacific Standard Time (“PST”) [Monday, June 10, 2013] and ends 08:59:59 pm, PST [Tuesday, June 18, 2013] (the “Entry Period”). Pacific Standard Time shall control for all purposes of the Promotion. Sponsor’s computer clock governs time.
 
As a condition of participating in Promotion, You agree to be fully and unconditionally bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Promotion or these Official Rules. 2.   HOW TO ENTER:
You may enter the Promotion by completing the Canyon Ranch survey during the Entry Period. To complete the survey and enter, go to the SparkPeople Blog and follow the links and instructions for entry. The short survey can also be found here. You must supply the requested information including your full name, address, a daytime telephone number and a working, valid e-mail address for which you are the authorized user. An e-mail “authorized user” is defined as the natural person who is assigned to an e-mail address by an Internet mail service, Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the e-mail address. In the case of a dispute regarding who submitted a particular online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account.

3.  SELECTION TO PARTICIPATE IN TRIAL COACHING PROGRAM AND RANDOM DRAWING:
 

1. Selection as a Coaching Program Tester in the Trial Coaching Program:

Twenty (20) entrants who have submitted an entry by completing the Canyon Ranch survey will be selected (“Coaching Program Testers”) by Sponsor to participate in a free eight (8) week online healthy weight coaching program (hereinafter referred to as the “Coaching Program”). In order to be eligible for selection as Coaching Program Tester, entries must be received by the close of the Entry Period. Coaching Program Testers will be used to evaluate the Coaching Program and provide feedback to the Sponsor.
 
All entrants who have completed the survey before the end of Entry Period will be evaluated by Sponsor as a potential Coaching Program Tester. Sponsor will initially evaluate the eligible entrants based on the answers provided in the submitted survey. Based on the Sponsor’s needs, including having diverse testers, Sponsor will select from those entrants expressing an interest to take part in the Coaching Program an uncertain number of entrants to participate in follow up phone interviews. The follow up interviews will be used to further evaluate the entrant’s interest in participating and willingness to provide feedback to the Sponsor regarding the Coaching Program as well as the amount of weight the entrant wants to lose. Sponsor’s selection of Coaching Program Testers is a matter of subjectivity subject to Sponsor’s needs, beliefs that an entrant is willing to participate and provide meaningful feedback and is in the Sponsor’s sole discretion. The Sponsor’s decisions are final and binding in all matters relating to the selection of Coaching Program Testers. 
 

2. Random Drawing for Canyon Ranch Package:

In addition to being eligible to be selected to participate in the Coaching Program, all eligible entries received by the close of the Entry Period are also eligible for a gift certificate for a two-night package for two (2) people at Canyon Ranch Tucson (hereinafter referred to as the “Canyon Ranch Package”). Within four (4) weeks after the conclusion of the Entry Period, Sponsor will conduct a random drawing (the “Random Drawing”) from all eligible entries to select the potential winner of the Canyon Ranch Package. The potential winner will be notified via the e-mail address or phone number associated with the entry as detailed in Section 4. The Canyon Ranch Package will be deemed to have been won when all conditions in these Official Rules are met.
 
4.  NOTIFICATION:
 

1. Notification of Selection of Potential Coaching Program Testers:

Selected Coaching Program Testers are potential Coaching Program Testers, subject to notification and verification. Potential Coaching Program Testers will be notified by phone or e-mail using the information associated with the potential Coaching Program Tester’s entry within ninety (90)  days following completion of the respective selection process for the Coaching Program. Potential Coaching Program Testers must respond to e-mail or voicemail notification within 48 hours or he/she will forfeit their opportunity to participate in the Coaching Program and, at Sponsors’ sole discretion, an alternate potential Coaching Program Tester may be selected from the remaining eligible entries. If the notification is returned as undeliverable or the potential Coaching Program Tester is otherwise unreachable for any reason, Sponsor may select an alternate potential Coaching Program Tester to participate in the Coaching Program, at Sponsor’s discretion. If there is a dispute as to who is the potential Coaching Program Tester for a given survey entry, Sponsor will consider the potential Coaching Program Tester to be the authorized account holder of the e-mail address associated with the respective Canyon Ranch survey.
 

2. Notification of Potential Winner in Random Drawing for Canyon Ranch Package:

The Canyon Ranch Package prize winner is a potential Canyon Ranch Package prize winner, subject to notification, verification and acceptance of such prize. The potential Canyon Ranch Package prize winner will be notified by phone or e-mail using the information associated with the potential Canyon Ranch Package prize winner’s entry within thirty (30) days following the Random Drawing for the Canyon Ranch Package. The potential Canyon Ranch Package prize winner must respond to e-mail or voicemail notification within 48 hours or he/she will forfeit the Canyon Ranch Package and, at Sponsors’ sole discretion, an alternate potential Canyon Ranch Package prize winner may be selected from the remaining eligible entries. If the notification is returned as undeliverable or the potential Canyon Ranch Package prize winner is otherwise unreachable for any reason, Sponsor may select an alternate potential Canyon Ranch Package prize winner, at Sponsor’s discretion. If there is a dispute as to who is the potential Canyon Ranch Package prize winner is for a given entry, Sponsor will consider the potential Canyon Ranch Package prize winner to be the authorized account holder of the e-mail address associated with the respective Canyon Ranch survey.
 

3. General Notification Requirements:

Potential Coaching Program Testers, the potential Canyon Ranch Package prize winner and the potential Canyon Ranch Package prize winner’s guest may, at the option of the Sponsor, be required to complete and sign an Affidavit of Eligibility and Liability Release, where legal, a Publicity Release, and IRS Form W-9. Failure to complete such forms within seven (7)  days of receipt of such request will result in forfeiture of Your selection for the Coaching Program or the Canyon Ranch Package, respectively.
 
ALL POTENTIAL COACHING PROGRAM TESTERS AND THE POTENTIAL CANYON RANCH PACKAGE PRIZE WINNER ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISION IS FINAL. UNLESS AND UNTIL AN ENTRANT HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE, THE RESPECTIVE ENTRANT IS NEITHER A COACHING PROGRAM TESTER NOR THE CANYON RANCH PACKAGE PRIZE WINNER.
 
5.  PrizeS and odds:
Twenty (20) entrants will be selected as Coaching Program Testers for a free eight (8) week healthy online weight Coaching Program with an Approximate Retail Value (“ARV”) of two thousand dollars ($2,000.00). The odds of being selected as tester will depend on the number of eligible entries received during the Entry Period and the quality of the entries submitted as judged by the criteria in Section 3(A).
 
One (1) entrant will receive a gift certificate for the Canyon Ranch Package, a two-night package for two (2) people, at Canyon Ranch Tucson, with an ARV of three thousand nine hundred dollars ($3,900.00). The odds of winning the Canyon Ranch Package will depend on the number of eligible entries received during the Entry Period. The Canyon Ranch Tucson two-night package includes:

• Gracious accommodations with thoughtful amenities to satisfy, delight and surround You in comfort.
• Three meals daily – fresh, gourmet creations combining great taste and nutrition – plus always-available healthy snacks.

6.  RESTRICTIONS ON THE COACHING PROGRAM AND CANYON RANCH PACKAGE:
The opportunity to participate as a Coaching Program Tester is not assignable or transferable. No cash equivalents or substitutions will be allowed except in the sole discretion of the Sponsor. Sponsor reserves the right to cancel, suspend, shorten or modify the Coaching Program for any reason.
 
The Canyon Ranch Package gift certificate is non-transferable, cannot be extended beyond the validity dates and retains no cash value. The Canyon Ranch Package gift certificate includes a resort amenities fee and sales tax. Reservations are subject to availability and black out dates will apply. The gift certificate is for deluxe accommodations and includes a $280 per person allowance toward spa, sports & wellness services. The gift certificate is valid for the Canyon Ranch Package prize winner only, is not transferable and has no monetary resale value. Prize does not include air and ground transportation, except for ground transportation to and from Tucson International Airport, and other expenses and incidental travel costs, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges not identified Section 5. The gift certificate expires one year from the date of issue and is subject to the following blackout dates: December 24-31, 2013, and March 2014. Other restrictions and blackout dates may apply.
 
ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Any required tax reporting forms will be furnished to the appropriate tax authorities.
 
7.   PUBLICITY RIGHTS:
Except where prohibited by law, by entering the Promotion, and as a condition of participating in this Promotion, You agree to allow Sponsor and/or Sponsor's designees the perpetual right to use Your name, biographical information, photos and/or likeness, statements, voice and city and state address for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission, except where prohibited by law. 
 
YOU FURTHER ACKNOWLEDGE THAT IF YOU ARE CHOSEN AS A COACHING PROGRAM TESTER OR THE CANYON RANCH PACKAGE PRIZE WINNER, YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNERS LIST.
 
8.  WINNERS list:
To obtain the names of the Canyon Ranch Package prize winner or the entrants selected to be Coaching Program Testers, any person may mail a self-addressed, stamped envelope after 90 days from the close of the Entry Period to Canyon Ranch, 8600 E. Rockcliff Road, Tucson, AZ  85750.  Attn: Winners’ List.  Requests must be received no later than three (3) months after the close of the Entry Period.
 
9.  GENERAL CONDITIONS:
By entering the Promotion, You agree: (1) to abide by these Official Rules, and the decisions of Sponsor in all respects relating to this Promotion, which shall be final and binding; (2) to furnish Sponsor with executed copies of any documents required by Sponsor in order to be confirmed as a winner, including without limitation, an Affidavit of Eligibility/Liability/Publicity Release as well as any other documents and/or written permissions; (3) to release and discharge the Sponsor and its affiliate companies, and their respective parent companies, subsidiaries, affiliates, prize suppliers, and Sponsor’s advertising, promotion, media, public relations and all their affiliates, and each of their respective agents, representatives, officers, managers, directors, members, shareholders and employees (collectively, the “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons including, without limitation, death, or property resulting, in whole or in part, directly or indirectly, from Your participation in the Promotion or any Promotion-related activity or the acceptance, possession, use or misuse of prize (or portion thereof); (4) to grant Publicity Rights as described in Section 7; and (5) to defend, indemnify and hold harmless each of the Released Parties from and against any and all claims or actions arising out of or in connection you’re your participation in the Promotion, any breach of representation made by You in connection with the Promotion, and the exercise by Sponsor or its designees of any of the rights granted by You in these Official Rules.
 
10.  LIMITATIONS OF LIABILITY:
To the maximum extent permitted by law, Released Parties expressly disclaim any and all warranties or conditions of any kind (whether express, implied, statutory or otherwise), including but not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose and non-infringement. Released Parties shall not be liable or responsible for those guarantees, warranties or conditions made or offered by advertisers, partners, manufacturers or suppliers, including those relating to the prizes. Under no circumstances shall related parties be held responsible or liable for a participant’s use of the information and/or products or services provided and/or made available through the Promotion or for errors or anomalies resulting in the unintended or erroneous participation, award of Promotion prize or other benefits under the Promotion to participants.
 
Released Parties offer no assurances, guarantees, warranties or conditions that the Promotion or the Site will be uninterrupted or error-free and does not guarantee the accuracy or reliability of any information obtained through the Promotion. IF, in the Sponsor's opinion, for any reason, the Promotion is not capable of running as planned, including, without limitation, insufficient entries, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Promotion, the Sponsor reserves the right at its sole discretion to modify or suspend the Promotion or to terminate the Promotion. In the event that the Promotion is cancelled or terminated prior to the stated expiration date, notice will be posted on the Site and the ARV of the prizes will be awarded to the extent required by law in a manner that is fair and equitable as determined by Sponsor. All interpretations of these Official Rules and decisions by Sponsor is final.
 
Sponsor also reserves the right to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE SPONSOR’S SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW.
 
11. GOVERNING LAW:
This Promotion is governed by the internal laws of the United States of America and the State of Arizona. Subject to, and without in any way limiting, the "Applicable Law/Jurisdiction" and “Arbitration” requirements set forth in the Terms & Conditions, any dispute related to this Promotion, these Official Rules, Sponsor’s Site or the Terms & Conditions shall be submitted to confidential arbitration in Arizona, except that, to the extent you have in any manner violated or threatened to violate Canyon Ranch’s intellectual property rights, Canyon Ranch may seek injunctive, equitable, or other appropriate relief in any state or federal court and You consent to exclusive jurisdiction and venue in the states and federal courts in the State of Arizona.
 
12.  PRIVACY:
By entering the Promotion, You agree to Sponsor’s use of Your personal information as described in Sponsor’s Privacy Policy.
 
BY ENTERING THIS PROMOTION, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND CONSENT TO SPONSOR’S PRIVACY POLICY AND SITE TERMS & CONDITIONS.
